摘要
我国《劳动合同法》的立法价值目标是实现劳动关系的和谐。但在《劳动合同法》的实施过程中,企业的抵制、规避行为,配套法规和规章制度的不健全以及地方政府、工会未能发挥应有作用导致《劳动合同法》的实施效果不容乐观。为此,要建立企业社会责任制度,促进企业自觉维护职工权益,并完善《劳动合同法》的相关配套制度,落实政府与工会在保护劳动者权益方面的积极作用。
The legislation value target of China's "Labor Contract Law" is to achieve the harmonious labor relations.However,in the course of implementation of "Labor Contract Law",the resistance and avoidance of enterprises,the lack of supporting laws and regulations,as well as the fail to achieve the desired effects of local government,trade unions lead to the fact that "Labor Contract Law" implementation effect is not optimistic.So we should build corporate social responsibility to promote enterprise consciously safeguard staff's interests,improve the related supporting systems of "Labor Contract Law",implement the positive role of the government and trade unions in protecting workers rights and interests.
