摘要
以西方经典国家和社会关系理论为理论基石,以我国经济社会发展现状为时代背景,探讨和构建政府(国家)和社会的理想关系,认为国家和社会的关系没有终极模式,要与现实政治的发展相和谐。二者的法理关系在逻辑结构上可以从目的、主体、客体、手段四方面分析。在此基础上,进一步从应然和实然两方面探讨政府与网络舆情的法理关系,为突发事件中网络舆情的政府管理和法律治理提供有力的理论指导。
This article, based on the western classical theory of the relationship of state and society, under the economic and social context in China, explores and builds the ideal relationship between a state and the society. It is believed that the relationship between a state and the society has no uhimate model, whereas it should be in harmony with the realities of political development. The legal relationship between government and network pub- lic opinion will be analyzed from perspectives of the goal, subjects, objects and means, which provide strong theoretical guidance for governance of dealing with emergencies.
