摘要
改革开放三十年来,中国法院人事制度的改革始终以法官职业化为核心,并在人员的选任、晋升、培训、考评和监督制度等方面取得了一定的成就。然而,由于脱离中国的制度语境和缺乏理性的改革分析,法院人事制度改革已经日益陷入窘境。回顾和反思三十年的改革历程,坚持有限司法独立的理念才是继续推进法院人事制度改革的理性路径。
In the last 30 years, the personnel system reforms of Chinese courts have focused on the professionalization of judges. Without doubt, we' ve achieved some accomplishments in the selection, promotion, training, assessment and supervision systems of judges. However, some of these reforms are caught in trouble due to their inconsistency with Chinese system context and the scarcity of reasonable analyses. After reflecting the reforms of the last 30 years, we should realize that it's better for us to improve judicial reforms with the premise of "limited judicial independence".
