摘要
为了揭示中国传统法律近代化的复杂多样性,以丧服制度在近代的变迁为考察中心,采用历史文献学与法律社会学等方法,认为丧服制度作为传统礼制和法律的重要组成部分,是传统法律儒家化的重要表现。在中国传统法律近代化过程中,作为传统法律重要内容的丧服制度经过了一个由修改到逐步废弃的过程,是传统法律近代化的重要标志。在丧服制度的变迁过程中,传统与现代、激进与保守、东方与西方等各种矛盾和冲突交织在一起,凸显了中国传统法律近代化的复杂多样性。
In order to reveal the complexity and diversity of modernization of Chinese traditional law, taking the changes of Mourning Apparel System in modern times as the investigation center, adapting the methods of historical documents and law sociology to analyze the research documents, a conclusion has drawn that as the important part of Chinese traditional Li system and law, Mourning Apparel System was the important display of Confusianization of traditional law. In the course of modernization of Chinese traditional law, as the important content of Chinese tradi- tional law, Mourning Apparel System was also gone through a very long course from revising to discarding and was the important symbol of modernization of Chinese traditional law. In the course of changes of Mourning Apparel Sys- tem, all kinds of contradictions mingled with conflicts about tradition and the contemporary age, radical and conservative, the East and the West. It manifested the complexity and diversity of modernization of Chinese traditional law.
