摘要
一直以来,土地是广大农民安身立命的根本。近年来,随着农村的产业结构调整,二、三产业的快速发展和农业规模化经营的兴起,农村剩余劳动力不断向城镇转移,农村土地承包经营权流转明显加快。文章通过对土地承包经营权流转的意义及流转过程中存在的问题分析,结合相关法律法规和国家政策,指出现行立法的不足并提出完善的建议,以期对该问题的解决有所裨益。
All the time,land is the basis of farmers＇ living.In recent years,with the rural industrial structure adjustment and the rapid development of the secondary and tertiary industries and the rise of scale of agricultural operations,rural surplus labor force constantly transfer to the town and circulation of rural land contracted management right apparently speeds up.By analyzing meanings of circulation of rural land contracted management right and problems in the process of circulation,the paper points out the existing legislation shortage and puts forward some advice the with consideration of our country＇s related policies,laws and regulations.
