摘要
19世纪初产生于德国的历史法学派,是西方法学流派中的一支重要力量,其思想主张在整个19世纪占据了德国法学研究的主导地位,引领了世界法学发展的潮流,并对以后的法律思想的发展也产生了深远的影响。通过总结德国历史法学派主要观点及当时和后世的学者对历史法学的正反面的评价,可以为我国法治现代化建设提供借鉴。
As an important legal school in Western Jurisprudence world, Historical School of law stemmed from German in the early of 19th Century whose opinions and claims play an important role in studying on German Law and which was a leading school during the whole 19th Century and have the great influence over the development of legal thoughts in subsequent to it. Upon analyaing and concluding the main claims and notes evaluated on one or contrary side given by the successive scholars, the paper reaches some experiences and lessons for China.
