摘要
阐述了民营医院执业遭遇纳税争议、权利义务不对等和政府监管乱象等法律瓶颈问题,指出当前缺乏对民营医院明确的法律定位,提出了明确法律定位、在定位的基础上制定纳税标准、落实现有规定,消除权利义务不平等现象、依法加大监管力度、依法化解人才危机、依法平等开放医保定点、依法规范医疗广告、建议制定《医院法》或《民营医院法》等八个方面的研究对策。
Legal bottlenecks such as tax dispute, imbalance of rights and duties and irrational regulation in private hospital practice are described. Lack of definite legal status for private hospital is the key problem. Definite legal status, formulating tax standards in accordance with law, implementing the law and regulations, eliminating unequal rights and duties on private hospitals, strengthening inspection, smoothing human resources crisis, equal competing the qualification of authorized hospitals for medical insurance, regulating medical advertisement and formulating hospital law or private hospital law are the main suggestions.
