摘要
现行法律虽未明文规定,但是通过一定的法律解释方法,可以将行政不作为纳入我国现有的国家赔偿范围。但如何判定依职权行政不作为的违法则成了理论研究和司法实践的重中之重。本文以日本判例为分析对象,并结合相应的日本学者理论,通过区分食品药品公害监管不作为类型与一般行政不作为类型,提出了判断依职权行政不作为是否违法的预见可能性、结果避免可能性、期待可能性和受损法益的重大性四项要件,并详述了各项要件所存有之内涵。
Although not defined in contemporary statutes, agency inaction might be fitted back into estab- lished scope of administrative compensation by certain essential law interpretation. Nonetheless, the approaches to identify authority agency inaction legitimacy have been the focus of theoretical research and judicial prac- tice. By analyzing Japan cases with corresponding Japanese scholars' theories, this Article therefore suggests four ingredients of judging authority agency inaction illegally or not, i. e. the predication possibility, the absten- tion possibility, the expectation possibility, and the importance of damaged legal interest, according to separating the food and drug pollution monitoring inaction from general agency inaction, then argues the connotation among those essential elements.
