摘要
排污权不是一项物权,只是基于国家行政许可所获得的附属性财产权,在内涵、目的与效力上都有其特殊性。由于市场机制的不完善与政府环境行政能力的限制,我国排污权交易的正当性有待进一步强化。我国应该逐步统一排污监测标准,增强市场定价功能,完善排污信息披露机制,界定排污权交易的适用范围。
The emission right is not a real right, but an ancillary property right obtained by national administrative license, so it is different in the content, purpose and effect. Due to the imperfection of the market mechanism and limitation of the government environmental administrative capacity, the legitimacy of China's emission trading is imperfect and should be strengthened further. In order to achieve that goal, China should gradually unify the emission monitoring standards, enhance market pricing function, improve the information disclosure mechanism and define the scope of emission trading.
