摘要
对政策与法之间关系的研究,已经到了该从形而上的研究,前进到形而下的研究的阶段了。这种形而下的研究是迄今为止我国学术界所未进行的,它具有两个特点或内容,一是关注对实例(个案)的研究;二是致力于政策与法和谐"相处"的机制建设,这种机制包括两个方面的内容,一是避免政策与宪法和法律相抵触的机制,另一个是进一步强化和"激活"立法机关的立法功能的机制,此二者相结合,才能使政策和法和谐"相处"。
The abstract and macroscopic study of the relationship between policies of the CPC and laws has been finished, and should be turned into the concrete and microcosmic study. This kind of study has two particulars or contents. One is caring for examples （cases）, and the other is working for the construction of the mechanism of living in peace with each other between policies of the CPC and laws. This mechanism includes two contents, one of which prevents policies from committing laws, and the other of which strengthens the legislative power of the legislative body.
