摘要
雇员人身损害赔偿责任包括三个构成要件:存在雇佣关系,雇员从事雇佣活动和雇员遭受人身损害。我国关于雇员人身损害赔偿责任的规定存在不真正连带责任运用中的问题和责任承担失衡问题,基于上述两个问题,本文提出完善的对策。
The constituent elements of the employee personal injury compensation liability is the existence of the employment relationship,engaged in employment activities and suffering personal injury.The question in our country is the using of the untrue joint and several liability and the imbalance of undertaking liability,so this paper issues the method of solving the questions.
