摘要
有效控制原则是当今国际法院裁判领土争端案件的重要依据。2008年"新加坡与马来西亚关于白礁岛、南礁岛及中岩礁主权争端"一案的判决即体现了该原则在国际法院中的适用,并为近来引发热议的我国钓鱼岛及南海诸岛主权争端问题提供了可资借鉴的必要参考。
The doctrine of effective control has become an important basis on which ICJ judgments involving territorial disputes were given. It has been reflected in the recent case concerning sovereignty over Pedra Branca,which may provide reference for settlement of sovereignty disputes over Diaoyu Island and South China Sea Islands.
