摘要
目前我国有关毒品犯罪控制下交付的法律依据主要包括我国政府批准的相关国际条约和协议,传统意义上的法律,以及具有"隐形法"性质的内部规范。存在问题:1.缺乏对控制下交付概念和分类的规定;2.缺乏对控制下交付主体的规定;3.缺乏对控制下交付适用条件的规定;等等。
In China, controlled delivery adopted in the investigation of drug crimes can find legal basis from the Government＇s approval of relevant international treaties and agreements, laws from the traditional aspect, and internal regulations which have the nature of“invisible law” Then some problems about the controlled delivery are as followed： firstly, lack of regulations on concepts and classification of controlled delivery ; secondly, lack of regulations on the subjects ; thirdly, lack of regulations on applicable conditions.
