摘要
关于侦查学的逻辑起点,理论界目前主要有三种观点。其中认为侦查学的逻辑起点是"刑事案件"的观点,以及认为侦查学的逻辑起点是犯罪事实的二重性命题的观点尚有几个问题待讨论,还需再斟酌。而认为侦查学的逻辑起点是犯罪行为的观点目前比较有说服力——此观点运用系统理论,从大系统到小系统,从外层到内层,逐层推导出侦查学的逻辑起点是犯罪行为。这是一个新思路,新视角。
At present, there are three kinds of arguments about the logic starting point of the subject of the criminal investigation. The argument that ＂criminal case＂ is the logic starting point of the subject of criminal investigation is not perfect, and the argument that criminal behavior is the logic starting point is persuasive, and the argument that the dual proposition of criminal facts is the logic starting point needs more discussion.
