摘要
法治作为规范和限制政治权力的制度性安排,与自然界一样,具有生态系统的某些特性。法治作为政治生态系统,其内涵远远大于法律和司法,法治不能从法律的内部推演出来;法治作为政治生态,需要与之相匹配且密不可分、相辅相成的民主、人权、自由、宪政等政治法律制度与价值观的支撑和滋养,自然法思想是法治的理论基石;法治通过对权力的有效制约,达致政治生态的平衡。
Legal system is used to make political power standard and limited, and like nature has its own ecological system. As a political ecological system, legal system has significance more than law and justice because it cannot be from itself, but closely related with democracy, human rights, freedom, constitution and others. The thought of the natural law is the theoretical cornerstone of legal system. Through effective limitation of power, the balance of political ecology can be reached.
