摘要
从合法性的角度看:具有事业单位法人地位的学校拥有聘用教师的权利。从合理性的角度看:教师人力资源特性,决定了学校对教师进行合同管理的适宜性;学校的非科层制特征,决定了学校教师不宜由行政机关派任;学校比行政机关更了解有关教师的信息,决定了聘用教师的决策权应在学校。
From a legal angle, the school with legal personality has the right to employ teachers. From a rational angle, teachers should be managed by contract in accordance with the characteristic of human resources of teachers; teachers should not be dispatched by government agencies because the school is not a bureaucratic apparatus; whether teachers should be employed is decided by schools rather than government agencies because schools are more familiar with teachers.
