摘要
从历史角度对我国体育地方立法进行了分析。结果表明:《体育法》颁布后,我国地方体育立法快速发展,同时也带来重复立法、经费匮乏、缺少地方特色等问题。未来体育地方立法宗旨要突出以人为本;立法形态要随《体育法》的修订而变化;当前应该以修改、修订为主要工作,继续增加一些创制性立法。体育地方立法协作将成为一种趋势,已经有一些区域进行法律实践,如何在我国现有立法体制框架下开展体育地方立法协作仍将是重要研究课题。
From the perspective of history the authors analyzed local sports legislation in China, and revealed the following findings： since the promulgation of the Sports Law, local sports legislation in China has been developing rapidly, whereas problems such as repeated legislation, fund shortage and local feature deficiency have also been brought up; future local sports legislation should aim at highlighting its people orientated characteristic; the form of legislation should vary with the revision of the Sports Law; currently the key jobs should be amendment and revision, and some system establishing legislations should be kept adding; local sports legislation cooperation will become a trend, and legal practice has been carried out in some areas, but how to develop local sports legislation cooperation under the framework of the existing legislation system in China will still be a major research subject.
