摘要
代理制度是商品经济高度发达的产物,当今世界主要存在两大代理制度,即大陆法代理制度和英美法代理制度。由于两大法系法律文化、历史传统、思维方式以及其他社会经济因素的不同,导致了这两大代理制度在理论基础、代理权发生、分类、价值追求等方面存在差异,但也出现了一些相似的地方。
Acting system is the product of highly developed commodity economy. There are two main acting systems in the world today—the mainland acting system and Anglo-American law of system. Because of the differences in law culture, historical tradition, methods of thinking and other social economic factors, there exists diffeerences in theory bases, occurrence of acting right, classification and value seeking in these two law systems. However, there is still similarity.
