摘要
行政合同是在近现代民主思想的影响下产生发展起来的,是一种较柔性的行政管理方式,它是权力因素和契约因素相结合的产物。行政合同中所体现的权力和契约的双重性造成了价值上的悖论,但是这两种价值并非根本上的对立冲突,而是可以互补相融的,形成一定程度中的释然。
Administrative contract is becoming a flexible administration manner effected by modem democratic thinking in modem society, and it is the result of integration of authority factor and contract factors. Administrative contract results in paradox value under the traditional understanding because of its two characters of power and contract. But these two values of administrative contract are not fundamental conflicts, they can exist together.
