摘要
宪政伦理研究从伦理的维度探讨宪政的正当性及其伦理意蕴,宪政的正当性基础在于它能保障人有尊严地生活。而宪政的伦理意蕴则体现在建立优良的伦理秩序,具体表现为公民与国家、国家与社会、人与自然等诸种关系和谐有序。宪政伦理的这种研究是对宪政研究的有益拓展,但国内学者涉猎这一研究者尚不多见,系统地整理这方面的资源对推动宪政伦理研究走向纵深实有必要。
The study of constitutionalism ethics concerns the legitimacy and ethical implication of constitutionalism from the dimen- sion of ethics. The foundation of constitutionalism＇s legitimacy consists in people can be guaranteed to live as dignified ones. The ethical implication is embodied in constituting eminent ethical order. It embodies in a set of relationship lying harmonious and orderly,Such as the relationship between citizens and the nation, the nation and society, human being and the nature, and so on. Such research by constitutionalism ethics is a beneficial development to study of constitutionalism. Yet, few domestic scholars dabble in the study. And it＇s necessary to compile relative data which can promote the study of constitutionalism ethics.
