中美文化产品争端由来已久。美国认为中国相关措施违反了WTO协定下的义务,中国则以保护"公共道德"为由进行抗辩。在WTO语境之下,保护"公共道德"的有关措施在"性质"和"实施"两个方面受到严格限制,这使得中国援引"公共道德"例外困难重重。尽管中国的文化产品管理方式可能受到WTO约束,但仍将继续拥有决定"公共道德"实质内容的权力。
The disputes between China and the United States on cultural products can be traced back many years. The US contends that the relevant measures taken by China have violated China's obligations under the WTO agreement, while China has turned to the protection of 'public morals' to defend itself. The protection of 'public morals' is one of the cases justified by the general exception clause under the WTO. However, measures in the name of protecting 'public morals' are subject to strict limitations with regard to their 'nature' and 'application,' making it difficult for China to resort to the exclusion clause of 'public morals.' Despite the fact that the way China manages its cultural products may possibly be subject to WTO restrictions, China still has the power to determine the substance of 'public morals.'
