摘要
本文提出了我国医疗纠纷出现上升和激化的问题,并阐述了妥善解决的方法。首先,介绍了国外有代表性的医疗纠纷的处理模式,如:庭外调解、司法解决、政府干预,以期起到借鉴效果。此外,还就减少医疗纠纷的发生,提出了见解,认为政府、医疗机构、医患双方均应该各司其职,尽可能地减少医疗纠纷的发生。最后,结合我国的实际情况,以浦东新区为例,就具体如何处理医疗纠纷提出了建议。
The problem were discussed of the rising and intensification of medical disputes in our country and then the means to resolve the problem were elaborated. Combining with the modes to dispose medical disputes as mediation out of the court, resolution in the court, intervention by the government, the measures to intervene medical disputes were proposed that the government, medical institutes and doctors and patients should take their own responsibility in their position. At last the advices to deal with medical disputes based on the case of Pudong district in Shanghai were discussed.
