摘要
《城乡规划法》、《物权法》等法律的出台使控制性详细规划的编制与管理面临严峻的挑战,控规中原有的问题愈加突出。本文试图从科学技术与公共政策的分化来认识控制性详细规划中存在的问题,为控规内容的完善提出新的思路;并适应行政体制改革与法律的要求,建立责权明确的控规编制与管理制度。
The new Urban and Rural Planning Law and Property Right Law bring challenges to the formulation and administration of the regulatory detailed planning. This paper analyzes the problems in the regulatory detailed planning by distinguishing the technologies and public policies and provides alternative idea for the improvement the plans. It also suggests establishing regulatory detailed plan making and administration system with clear rights and responsibilities according to the administrative system reform and the requirement of related laws.
