摘要
当前,妇女就业歧视的现象非常普遍,而且有许多歧视来自政府部门。随着公民法治意识的不断提高,越来越多的妇女开始拿起法律的武器(例如行政诉讼)来保护自己的合法权益。从宪政的视角解读此类诉讼的法理本质,采用实证的方法分析此类诉讼面临的困境,即受理难、审理难、处理难。笔者从社会意识层面、法制层面、行政诉讼层面分析问题的成因,在比较国外相关情况的基础上,从宪法司法化、行政诉讼法和配套法律的修订等角度提出解决的思路。
At present, discrimination of women employment is becoming more and more seriously, and this discrimination is from government bodies. With rising for the people's consciousness of the rule of law, more and more women begin to protect their own legal fight through litigation, such as judicial review. This paper analyzes the jurisprudence of this kind of litigation under eonstitutionalism, and its challenges including difficulty to accept adjudication through some cases, At the same time , it analyzes the reason from social consciousness, legal system, administrative litigation. Finally constitution used by judicial system, revise of administrative litigation law and other relevant law are suggested by this paper after comparison with other countries.
