摘要
当事人制度,是刑事附带民事诉讼制度的一个重要组成部分。由于该制度的相关立法过于简单,给当前的刑事附带民事诉讼司法实践带来了诸多困惑与分歧。在构建社会主义和谐社会的今天,及时完善刑事附带民事诉讼当事人制度立法,准确司法,有利于保护当事人的合法权益,促进社会和谐。
The accurate justice of litigants legislative system is good to protect the legitimate rights and interests and promots social harmony. Litigants legislative system is an important compoent of Criminal civil spin-off system, it has brought a lot of confusion and disagreement to the curkeut justice practill because the criminal system of covil litigation. We should perfect the criminal civil litigation system timely to construct a harmonious socialist society better.
