摘要
我国目前尚无专门的法律对农村房屋拆迁进行规制。实践中,公共利益界定不清、拆迁程序不公正、安置补偿不合理、权利救济渠道不畅,是困扰当前农村房屋拆迁的主要问题。解决这些问题的关键,是尽快制定专门的征收法律,对征收集体土地和拆迁农村房屋两种行为分别做出规范,对拆迁补偿原则、补偿方式、拆迁程序、权利救济、法律责任等问题做出具体规定,以确保农民的合法权益,促进社会和谐稳定。
Rural housing demolition is defined by the current laws as a form of land condemnation and demolition and resettlement which is not a law independent of land condemnation. At present there is no specific law to regulate rural housing demolition and resettlement. Consequently, many problems are facing the demolition and resettlement of rural housing. The major issues are ambiguous definition of public interest, unjust procedures, unreasonable compensation, and blocked channels for right remedy. The key to solving these problems is to enact special law to regulate land condemnation and condemnation of collective land and rural housing respectively. The law should make specific and definite provisions on the principles, methods, procedures of demolition and resettlement of land and house as well as on right remedy and the legal responsibilities involved. This way, the lawful rights and interests of rural residents would be protected and social harmony and stability would be achieved.
