摘要
为了构建合理而有效的流域生态补偿机制,从法学的角度探讨了流域生态补偿的内涵和体系:从流域的概念、流域生态补偿的范围、流域生态补偿的主体、流域生态补偿的惩罚性机制等4方面阐述了流域生态补偿的内涵;从流域生态服务价值的评估体系、流域生态补偿的转移支付体系和流域生态补偿的管理体系等几个方面分析了流域生态补偿体系。
In order to establish rational and effective ecological compensation mechanism in river basins,the definition and system of ecological compensation were discussed from the viewpoint of law.The definition of ecological compensation in river basins was introduced based on the following 4 aspects: definition of a river basin;range,main body and penalty mechanism of ecological compensation of river basins.The system of ecological compensation in river basins was analyzed from the following 3 aspects: evaluating system of ecological service in a river basin,transfer payment system and management system of ecological compensation in river basins.
