摘要
农地发展权是国家土地权利的一种,过去很长一段时间里淹没在土地所有权中,这一权利,在农业社会时不太明显,随着社会经济发展对土地需求压力的增大,国家对土地利用的控制也进一步增强,这一权利的社会实现和价值体现才逐步增强,逐步为各利益主体和社会所认识和争夺。文章介绍了农地发展权的概念与内涵,对农地发展权的归属进行了总结,比较分析和评价了几种不同的观点,认为根据我国社会经济性质和土地制度特性,农地发展权应归属于国家。
As the development of society and economy needs more and more land,as well as the gorvernment has further strengthened the control for land use;the social realization and valueble embodiment of this right has gradually increased;it is also gradually recognized and scrambled for by various interest subjects and society.The paper introduces the concept and the meaning concerning the right of farmland development,summarizes the entitlement,as well as analyses and evaluates several different views.The paper offers that according to the social and economic character and the speciality of land system of China,the right of farmland development should belong to the government.
