摘要
我国新闻法不发达,依靠新闻侵权法借以规范新闻媒体的新闻行为,具有重要意义。同样,研究新闻侵权抗辩,则从另一个角度规范新闻行为,保护好新闻媒体的新闻自由权利。中国的新闻侵权抗辩是一个严密的体系,具体规则明确。正确主张新闻侵权抗辩事由,新闻媒体可以对抗新闻侵权请求权,免除自己的侵权责任。但新闻侵权抗辩滥用,则构成侵权责任。
The law of news in China is not well developed,so it＇ s very important to standardize the news media by law of news tort. Meanwhile, it＇ s also another way to guarantee the news action and protect rights of news freedom of the media by studying of defense against news tort. The defense against news tort is a strict system, which has the clear rules. The news media can defense against claim right for infringement of news and avoid its own responsibility of tort by claim the tort defense reason correctly. But the abuse of defense against news tort should bear the responsibility of tort.
