摘要
大学自治历来是大学发展遵循的重要原则,但在现代法治社会中,大学自治权与受教育自由权之间的冲突在大学校园越来越多,二者的冲突主要体现在教学自由权与学习自由权,以及行政管理权与基本的受教育权之间。对此应加强大学内部规则的深化,设立学术仲裁委员会,解决、完善大学各项管理制度,以法律手段平衡权力与权利,以实现和谐大学校园。
Autonomy of university＇is the important principle in the improvement of university. But in the legal society, the conflict between the autonomy fight of university and the free education fight has brought unbalance in university, the conflict exists in two aspects. So , we should strengthen the law＇s improvement of university rule, set up science arbitrate committee , and perfect university＇s manage system by the law instrument to balance power and fight,in order to realize the harmonious college.
