摘要
在当前我国逐步走向法治社会的过程中,实现大学制度改革的法治化,是高等教育发展面临的一个重要课题。大学制度改革法治化的主要内容,包括制度改革重大决策的法律化和大学与政府关系的法律化。前者指以法律形式来表现政府的重大决策,通过法律程序制定政策,实现政策制定过程的科学、民主、公开;后者指明确大学的法律地位,在法律上规定大学与政府的有关权限职责,使大学与政府的关系构筑在法律的基础之上。
In the process of a law-governance society, realizing the law-governance of system reform of universities is an important subject in higher education development. The law-governance in system reform of universities contains two aspects, formulating major policies based on laws and adjusting relations between universities and goverments based on laws. The former refers to present the major policies in the form of laws, to make policies by legal procedure, and to realize the scientifical,democratical,openly characteristics of the process of formulating laws. The latter means to clarify the legal status of universities, to define rights and responsibilties of universities and goverments, fanally to set the relation between universities and goverments on the foundation of laws.
