摘要
环境保护运动背后隐藏着复杂的利益内涵。当工业文明步入困境,不同主体之间利益冲突和利益博弈的必然结果,就是要求建立超越工业文明的生态文明。在生态文明建设过程中,必将产生新的利益冲突和利益博弈。法律为解决利益冲突和规范利益博弈定下了规则和程序,从而将利益冲突和利益博弈纳入了法律的调控。因此,要充分发挥法律在生态文明建设过程中的调控作用,不断加强和完善生态环境法治。
When the industrial civilization gets into a fix, it is necessary to develop the ecological civilization due to the inevitable consequence of interest conflicts and interest games between various subjects. New conflict and game of interest will surely rise during the process of developing ecological civilization. The legisla- tion control should be regulated and enhanced to slove conflicts of interest and conducte games of interest. Therefore, we must allow a full play of the function of law during the process of developing ecological civilization, and strengthen the environmental legal system constantly.
