摘要
耕地保护问题随着社会变迁而发展,耕地异地代保就是这一过程中的产物。在耕地后备资源越来越匮乏的省区,"吃饭"与"建设"的矛盾越来越尖锐。如何既保证国家粮食安全和生态安全,又保证区域间公平高效地发展是当前地方政府耕地保护的一个难点。本文从农地发展权的视角,以农地发展权为国家粮食安全和生态安全的载体,构建耕地总量动态平衡下的区域耕地保护补偿机制,试图以农地发展权的产权手段来解决"异地指标调剂"的跨区域耕地保护问题,为中国耕地保护制度改革提供了一个思路。
The paper aims to erect compensation mechamism of cultivated land protection under general dynamic balance of cultivated land in China from an vies of rural land development rights. Method of theoretical analysis .and comparative analysis is employed. The results indicate that it is the very right time to construct rural land development rights in China to resolve the problem of compensation mechamism of cultivated land protection in different regions of China. In fact, rural land development rights must be an elastic method of land policy＇s participation in macro-control and play important roles in implement of lane policy such as land expropriation system, land planning etc.
