摘要
非物质文化遗产是人类智力活动的产物,本质是信息,是知识产权的客体。利用知识产权制度保护非物质文化遗产具有正当性。保护非物质文化遗产的具体知识产权制度有专利权保护、著作权保护、商业秘密保护、商标权保护专门知识产权保护等模式。非物质文化遗产的内容及其广泛,对它的保护依赖于以整个知识产权制度为基础的综合手段。
The intangible culture heritage is the product of human intellectual activities. Its essence is information, so it is a new object of intellectual property protection. The intellectual property protection on the intangible culture heritage is the righteous- ness. Detailed systems which protect the intangible culture heritage include patent right protection mode, copyright protection mode, commercial secrets protection mode, trade-mark right protection mode and specially protection mode. Because the content of the intangible culture heritage is various, its protection needs comprehensive methods which are based on intellectual property mechanism.
