摘要随着现代科学技术的发展 ,传统知识的价值越来越为人们所认识并日益得到广泛利用 ,因而拥有传统知识的社区、民族和国家尤其是发展中国家要求法律保护传统知识的呼声越来越高。然而 ,大多数传统知识产生的年代久远、属于集体创造和口头传播 ,很难利用现行知识产权制度予以保护。因此 ,有必要在分析现行知识产权制度保护传统知识的实践与局限性基础上 ,探索其他的法律保护形式 ,并结合我国对传统知识保护的现状 ,提出相应的对策。 The value of traditional knowledge has been increacingly realized and it has been widely used with the development of modern science and technology. More and more holders of traditional knowledge, such as some communities, nations and countries esp. developing countries, require strongly to legally protect their traditional knowledge. But it is difficult to protect traditional knowledge with modern intellectual property system owing to its long history and collective creativity and oral spread. In this case, it is necessary to explore other laws to protect traditional knowledge based on the practice of protection with modern intellectual property system, and this paper puts forward some policies to protect traditional knowledge for China.
