摘要
期待可能性从其诞生之日起,经不断完善和发展,已在大陆法系的许多国家和地区占有重要的地位,即便其余欧洲国家的刑法理论和刑事审判实践也深受其影响。追根溯源,期待可能性理论具有较大生命力使然,而这种生命力又来源于其坚实的理论根基,我们应将该理论在我国刑法理论的框架内合理引入。
The theory of ＂expectancy possibility＂ has been greatly perfected and developed after its birth. As a result, it has held a very important position in the theory and practice of criminal law in many continental countries with a legal system and other European countries. This is because the theory of ＂expectancy possibility＂ is full of vitality, which comes from its strong theory base. So, it is necessary for us to introduce this theory nationally in the circle of our criminal theory.
