摘要
证明责任分配是证据法中的核心内容,又是决定诉讼结果的关键性因素。本文从正确认识证明责任的含义入手,结合证明责任分配的理论,对我国证明责任分配的法律规定,尤其是证明责任分配的司法自由裁量问题进行了论述。
The distribution of burden of proof is the core in the evidence rules and also the critical factor to decide the result of a lawsuit. Based on the correct knowledge of what the burden of proof means and on the theory of the distribution of burden of proof, the paper expounds our legal stipulations about the distribution of burden of proof, especially the judicial discretion for distribution of burden of proof.
