摘要
就业平等权是一种具体平等权,理应包括就业形式平等和就业实质平等的内容,也意味着在就业方面既要适用法律平等,又要受立法的平等保护,其效力既能拘束国家的立法权、行政权、司法权,也能拘束私人行为。
Equal employment right is a kind of concrete equal right and should include the contents of equal employment form and equal employment essence and also means that the employment not only accords with legal equality but also is protected by legislative equality. The effect of the equal employment right can not only limit national legislative right and judicial right but also limit private behaviors.
