摘要
在法律现代化的历史进程中,当代中国司法应当扮演更为积极的角色来应对法律移植带来的诸如文化冲突之类的挑战。在这一点上,中国古代的法律宣教传统对于我们今天的法治建设仍然具有借鉴意义。
In the process of the modernization of our legal system, our judicature should play a more active role to deal with the challenges such as cultural conflicts which are brought about by Iaw transpIantations. We can draw lessons from ancient Chinese legal traditions on this point.
