摘要
现代法治建设中,国家立法与民间规则构成相辅相成的统一体,地方立法尤其需要吸纳民间规则等法律文化本土资源。本文通过民间规则之特征的比较研究,互动关系之构建的缘由探讨,以及内化融合之路径的制度设计,分析中国地方立法与民间规则的相互关联,以体现本土法律文化的独有价值以及在当代立法、执法、司法中的实际效应。
In the modern construction of law, national regulations and folk rules are an independent and interactional entity . It is essential for the local legislation to absorb native resources such as folk rules. In this paper, the author studies the characters of the folk rules by comparison, analyzes the rea- sons of building up the interrelation between local regulations and folk rules, designs a system to combine them, and analyzes the connection between them. Through the upwards study and analysis, we can find out the particular value of the native resources and actual effects in the legislation, administration and justice.
