摘要
目前,关于少数民族传统文化立法保护,我国形成了以《文物保护法》为核心的保护物质文化遗产法律体系和以《非物质文化遗产保护法》为核心的保护非物质文化遗产的法律体系并存的立法格局。我们应更新立法理念,统一立法指导思想,加快国家法律立法工作,尽快制定通过《非物质文化遗产保护法》,并注意与《保护非物质文化遗产公约》、《保护和促进文化表现形式多样性公约》相衔接。加强抢救保护少数民族风俗习惯的立法执法工作,注重法律实施,创新保护机制。
At present, about the national minority traditional culture legislation protection, our country has formed ＂Cultural relics preservation law＂ as the core protection material cultural heritage legal framework and by ＂non - material cultural heritage protection law＂ the legislation pattern which coexists for the core protection non - material cultural heritage legal framework. We should update the idea of legislation, uniform legislation guiding ideology, speed up the country~ legislative work, for- mulate and put through ＂non -material cultural heritage protection law＂ as soon as possible and link up with ＂protect the non - material cultural heritage convention＂, ＂Protection and promotion of cultural manifestations of the CBD＂. Speed up the rescue of the protection of minority customs legislation and enforcement work and pay attention to the enforcement of the law, innovative protection mechanisms.
