摘要
在农地集体所有制度与土地承包政策框架下,由于土地的占有、使用、收益、处分权在不同经济主体之间的模糊配置与分割,形成了所有权对使用权的过多剥夺与侵害,限制了土地财产价值的充分实现。合理界定国家、集体、农户之间的权利义务关系,进一步解除对农户土地权利的约束,是农民土地财产价值得以充分实现的保障。
Under the frame of collective ownership of rural land and land-contracting policy, the deprivation and infraction of land ownership rights upon land use rights was formed because the possess, use, revenue and disposing right of land were allocated among the different economic objects, which restricted adequate realization of the property value of land. Defining reasonably the right and duty among country, the collective and farmer as well as releasing the limitation on farmer＇ s land can ensure the realization of the property value of farmer＇ s land.
