摘要
专利组合理论作为一种新的专利经济理论形态,是随着世界范围内专利保护强度的加大和企业及其市场竞争程度的提高而产生的。从专利组合的存在价值和专利组合过程中的成本构成的角度,对专利组合的形成机制进行了概念分析;同时,在分析的基础上,结合中国企业实际,给出了一些规范性的政策建议。
As a new theory, the patent portfolio theory is generated along with the increase of the level of market competition and the en- hancement of the IPRs protection in the world. The paper analyses the appearing mechanism of patent portfolio from the perspective of both the value and the cost of patent portfolio. In the end, it presents some canonical countermeasures and suggestions according to the reality in China.
