摘要
民事诉讼中以当事人对等辩论作为发现案件真实的基本方法,完善和扩充当事人收集证据的能力,是在辩论主义诉讼原则下证据制度的一个发展方向。本文介绍了日本民事诉讼法证据收集制度的历史演变、改革与创新的过程,分析了各种证据收集制度的基本规则、实践及法理。
In civil litigation, the way of discovering truth is based on the parties＇ debating equality. Perfecting and strengthening the parties＇ ahitity to gather evidence indicates the trend of development of evidence system in the adversary system. The article discusses the development of the rule of evidence gathering, its refoming and new ideas in Japaness civil litigation. The article also analyzes basic rules, cases and jurisprudential issues of evidence gathering system in Japaness civil procedural law.
