摘要
我国大陆学界对我国是否存在特别权力关系以及是否有必要引进这一理论存在重大分歧。应当引进“修正后的特别权力关系理论”的积极、合理因素,顺应我国法治发展的趋势,以现代法治理念为指导,从权利、权力、程序、司法等维度探寻符合我国国情的特别权力关系法治化道路。
There existed great diverge on whether there exited special power relation and whether it is necessary to introduce this theory in mainland scholars in China. The positive and reasonable factors in ＂the theory of special power relation after revising＂ should be introduced into to adjust the trend of development of rule of law in China and guiding by the modern law ideas, from the perspective of right, power, procedure, justice and etc, we explore the road of legalization of the special power relation matching the situation of our country.
