摘要
司法公正与公信是一种互动的关系,形成二者之间良性互动的关键是沟通法官与民众对于公正的理解,使纸面之公正转化为民众所认可的公正。法院的职能定位是司法公正转化为公信的关键,平衡法院的出世与入世、法官的主动与被动、规则之治与纠纷解决、精英治理与民众参与等四个方面,探讨如何沟通法院与民众对于公正的理解,使公正转化为公信。
The relationship between justice of judicature and the public trust of judicature is one of a benign mutual action but it is not so in China today. In order to transform the justice on paper to the justice recognized by the public, the key is to connect the understanding of justice between judge and populace. This article researches how to communicate the understanding of justice between judge and populace and to transform justice of judicature to public trust of judicature from the following four aspects： enter the world or renounce the world of balance court, initiation or passivity of the judge, rule by regulation or dispute settlement, and elite government or mass participation.
