摘要
高校内部规则是高校法制的重要组成部分。目前,高校内部规则以效率与秩序为其现实价值取向,而忽视其理想价值——公平与正义。高校内部规则适用特别权力关系,理想价值的实现需要用公务法人的内部规则效力条件和法律保留原则对其进行有利的效力规制。法律调控上应坚持正当程序原则并建立一系列调控机制。
University bylaws are an important part of school legal system. Currently, university bylaws aim at efficiency and order as its practical value and ignores the ideal value, namely, justice and equity. University bylaws apply to special power relation and the achievement of ideal value needs to use the conditions of bylaw force and legal retaining principle to beneficially standardize and control public legal persons＇ actions. As to the legal regulation, the principle of rightful procedure should be upheld and a series of regulation mechanisms should be established.
