摘要
社会性别理论是20世纪以来社会科学研究所采取的一种崭新方法。将社会性别理论引入法学研究,有助于开拓法学研究的理论视野,为法律规范赋予新的活力。法律的社会性别分析,不仅关注法律规范的表述模式,而且关注立法的价值取向,关注法律的目标实现,关注法律的功能和实际作用的发挥,关注法律实施的社会效果。社会性别分析理论,对如何实现法律权利的实质平等,提供了分析的视角,尽管在如何操作的层面,还有许多问题需要展开深入的思考和论证。
Gender theory, a new method adopted in social scientific research since 20th century, lends itself to the exploiting of the academic view of jurisprudential study, infuses new vigor into legal rules when it＇s being introduced into legal research. The analyses of law＇s social gender focus on not only the description pattern of legal rules, but legislation value orientation, achievement of law＇s goals, exertion of law＇s function besides its actual roles, and social effects on law enforcement. Gender analysis theory provides an entirely new analyzing angle for how to realize substantial equality of legal rights, though there are still questions, which should be thought and proved deeply.
