摘要
刑事诉讼具备工具价值与独立价值两大类型价值。刑事诉讼的工具价值即其外在价值,刑事诉讼独立价值是体现刑事诉讼活动本身符合公正等价值要求的优秀品质,是独立于实体结果之外的本体价值。刑事诉讼价值中既存在工具价值内部价值取向之间的冲突,即正义、效益、自由、秩序、安全的冲突,又存在工具价值与独立价值之间的冲突。要坚持适度平衡的原则,在刑事诉讼中的不同阶段公正与效益应各有侧重,自由优先、兼顾安全,优先考虑刑事诉讼的独立价值,兼顾工具价值。
The criminal litigation has two kinds of value concluding artifice and independence. The artifice value namely it is outside value, while the independence value of criminal litigation exposes the excellent quality of justice and other good characteristics showed by criminal activities. The independent value refers to the value on itself which stands alone from its substantial consequences. Conflicts are existed between interior value orientations of tool value, that is conflicts between Justice, benefit, freedom, order, and security. At the same time, conflicts between tool value and independence value are also existed. The principle of moderation and balance should be insisted in the criminal litigation. Justice and efficiency should be stressed respectively on the different stage of criminal litigation. Freedom first, while security also be considered. That is, the independence quality of criminal litigation should be considered prior to its tool value.
