摘要
由市场规制法、国家投资经营法、宏观调控法以及劳动和社会保障法构成的经济法律体系中某些制度中的缺失或不足,直接导致矿难的发生或者是造成矿难的深层次原因。针对这些问题,可以采取的经济法律对策有完善统一的矿产资源法律体系,理顺矿产资源法律关系中国家、地方政府和各开发利用人之间的法律关系,用计划法律制度实现矿产资源规划法制化,完善税法,发挥税收杠杆对矿业市场的宏观调控功能,完善矿业权市场化法律机制,实现有效的政府监管,改革矿山安全投资体制,发挥政府对矿业安全投资的宏观调控功能,完善劳动和社会保障制度对矿工实行特别保护。
The system of economic law consists of market control law, state investment and management law, macro - regulation law and law of labour and social security. Some lacks of the economic laws directly result in the mining disasters or is the deep reasons of the mining disasters. According to these problems, what we can do as follows： improving the law system of the mineral resources; clearing the law relation of the mineral resources among the country, local governments and the people who explore and use mineral resources; using plan regulations to realize the legal condition of the mineral resources＇plan; improving the tax law so as to use the tax barg functions to regulate the mineral market ; improving the law system of the mineral property to realize the effective government regulation; reforming the investing system for the mine security; improving the labor and social security system to protect the miners specially.
